DAMAGES AWARDED.
MALICIOUS PERSECUTION. (miss ASSOCIATION TELEGRAM.) HAMILTON, December 2. Judgment for plaintiff was entered in an action for £SOO damages brought in the Supreme Court to-day before Mr Justice. Herdman by Edwin Coubray, cinema cameraman, against Alexander Marky, tiliu producer and managing director of Marky Films, Ltd., New Zealand, for malicious persecution. The action arose out of Marky issuing a search warrant against plaintiff and submitting his person and luggage to a search, Marky having entertained suspicions that Coubray was posting awav some copies of'film, the propertv. of Marky Films. His Honour held that plaintiff had proved his case, but said that damages in sCich a case could only be nominal, as plaintiff to some extent had precipitated .the whole thing. Plaintiff was awarded £lO, with 20 guineas, costs and disbursements.
