APPLICATION FOR ALIMONY.
JOCKEY TO PAY £4/15/- WEEKLY. [THE PRESS Special Service.] AUCKLAND, December 1. A well-known Auckland jockey, Benjamin Kinsman Deeley, • was the respondent in an application for permanent alimony, before Mr Justice Smith in the Supremo Court to-day. The r>etitioner was Doris Madge Elizabeth Deeley (Mr J. J. Sullivan). Mr IS. H. Nortlicroft appeared for the respondent. Deeley was cross-examined by Mr Sullivan about the money lie had in the bank. This, he said, amounted to about £2000: hut he might also have "a few pounds" in his current account. A Week ago he filed an affidavit that the amount was £2401). T.ast year his bank account stood at £3500, but he had since made investments in a company with £ISOO of capital, of which he lield £1499. That company had absorbed about £IBOO of his income in tlio past twolvo months. Until eight or nine months ago, Deeley said, he was paying his wife £5 a week for the support of herself and jlv& children, aged eight and nine years. Cross-examined about an offence of bo:nt; drunk m charge of a motor-car, Deelev said he had pleaded domestic trouble. 'lt seems to be a vicious circle " remarked Mr Sullivan in connexion with Ins business venture. Respondent's Two Shops. Deeley said ho had taken two shops. Ihe rental of ono expired to-day and lie had abandoned it. The tenure of tno other would continue for two and a half years. Mr Nortlicroft said his client's capital was rapidly disappearing, and an attempt was being niatlo to curtail the loss. To his Honour the witness said he started on a falling market. Goods k ere no, in demand,, and he lost capital. His Honour made an order for the respondent to pay his wife £1 15s a week permanent maintenance.
