CASE DISMISSED.

CONSTABLE THREATENED WITH PROSECUTION.

(SfMlAt TO "THS F&Z88.") WELLINGTON, May 12. A threat to proceed against a policeman marked the end of a police cose against Harold Brown, a well-known Wellington merchant, to-day. Six months ago Brown had his motor license taken away when he was convicted of being drunk in charge of a motor-car, and he was alleged to have been drunk in charge of a motor-car in.Courtenay place last night. Brown was walked to the police station, not being allowed to travel in the car, though his son was in it, and could drive. It was alleged that his arm was twisted badly on the way. When Constable Gillard entered the box to give evidence, there was a duel between him and Mr J. J. McGrath, counsel for Brown. "Why did you walk him to the station?" asked Mr McGrath. "Been use there was not room for three people in the car," said the constable.

Mr McGrath: That's very strange. You allowed four people to get in it." Later, three doctors had testified that they had called at the police station to examine Brown, and each was positive that he had not been drunk. "Why did you think that he was dmnkP" asked Mr McGrath.

"Because he went against my signal." was witness's answer. Mr McGrath, pounding his table: This will not bo the end of this case. Your conduct will be reported to the Commissioner, and them will be an action against you. This has arisen simply because you lost your temper when he went against your signal, The Magistrate dismissed the case, saving that unnecessary severity had been employed in the treatment of the prisoner.
