* PUBLICATION OF MISLEADING PARTICULARS.
A FAR-REACHING SECTION.
An important provision in the Sale of Foods and Drugs Amendment Act, which waß passed by Parliament during the present session, is that relating to the publication of particulars in respect of foods and drugs which are likely to mislead or deceive the public. The Medical Officer of Health (Dr. T. Fletcher Telford), in drawing a reporter's attention to the section, remarked that it was of importance not only to those who manufacture and sell foods and drugs, but also to printers and others connected .with the publication of matter relating to foods and drugs. The section referred to is Section 9, and it reads as follows: — Every person commits an offence who, being the seller of any food or drug, or the agent or servant of the seller, publishes or causes to bo published any statement, design, or device relating to such food or drug, or to any ingredient thereof, which directly or by implication qualifies or is contrary to any particulars required by regulations under the principal Act to be worked on, or attached to packages containing any such food or drug, or which is calculated, or is likely to deceive the purchaser in regard to the properties of such food or drug. For the purposes of this section a statement shall be deemed to be published if it is inserted in any newspaper printed and published in New Zealand, or is publicly exhibited in view of persons in any road, street, or public place, or is contained in any document which is sent to any person through the Post Office, or otherwise, or which is delivered to any person, on left upon the premises in the occupation of any person. In reply to the reporter's enquiries, Dr. Telford said that he did not understand that the intention of the section was to hold newspapers responsible for the publication of misleading statements, contained in advertisements, regarding any food or drug, except so far as disclosing the name of the advertiser in those instances in which the advertiser's name did not appear in the advertisement.
