A CONTESTED WILL.
AN ACTION DISMISSED. (By Cable —Preas Association—Copyright.) (Australian and N.Z. Cable' Association.} LONDON, April 6. The action against the executors of the late Sir Joseph Whitworth was dismissed with costs. Mr Justice Eve said that the odious, disgraceful conduct' charged against the defendant had been entirely disproved. The attitude of plaintiffs in persisting with their charges was an outrage. There was no evidence of the testator's mental incapacity. Mrs Uniacke's interests had been properly looked after.
[A message from, London on March 23rd. said: Judgment has been reserved in the case in which the will of Sir Joseph Whitworth, whose estate was valued at £1,500,000, was contested. The administrator of the estate of the lato Mrs Uniacke, wife of an Australian named Uniacke, who was heiress-aj-law. sued for the setting aside of a deed yigned by her relinquishing claims upon the estate in return for the payment by the executors of £25,000. Sir Joseph Whitworth died in 1887, and it was alleged that when ho was suffering from senile decay he was persuaded by Lady Whitworth and two executors to leave everything to them, to the exclusion of Mrs Uniacke. Viscount Bryce gave evidence that the executors were men of high standing socially and officially. Evidence was also given that the testator was fully capable of making a will. Counsel for the defence asked the judge to scyy that plaintiff's charges were a wicked mass of lies.]
