ACCIDENT IN BATTLE.
A decision was recently gnren in th» Brisbane District Court by -Judge Jameson, in a case in which S. B. Howard, a returned wounded soldier, claimed from the City Mutual Insurance Company £100 in respect of an accident accident was alleged to have occurred in France through the premwure explosion of a British shell while Howard was advancing on the German imos. The defence was that the plaintuf.was injured in the ordinary course of warHonour found that Howard was injured by an accident within _ tnfl meaning of the policy , an <l gave judgment against the City Mutual for £100, with costs. He addeu that the matter was of such importance that ho wonia give a written judgment in January.
