In tho same case a motion for leave to c&ercisc power of sale under mortgage was granted. The case of Sir "W. B. Perceval (Mr Fryer) v. H. J. Murriner (Mr Sargeant), a civil action, was ordered to stand ever for the present, as a settlement was being arranged. MAGISTERIAL. "(Before Mr T. A. B. Bailey, S.M.) DRUNKENNESS. Two first offenders' were each fined Es. POSTAL THEFT. "William Dnniol O'Reilly (Mr J. A. Cassiay) tvs.s charged with the theft at Cuivcrden of £4 13s, and £1 lid, on various dates, from the Post-ma«ter-fjencral of New Zealand. Mr Cassidy said that his client would j'load guiltv. The lad, who was about 19 y&i-rs ol had said that the offences vi-ere, to sonic extent, due to muddling in his accounts. Chief-Detective McHveuey said that, with rtspect to the fust sum mentionid, £'1 13s, the money had been handed to acc'sed by a Mr Thompson, with a deposit slip, in order that it might be placed to the last-mentioned's credit m the savings bank. Accused kept tho money and tho deposit slip, stamping a receiot on the bank book, and the ■ tJip had subsequently been found by the -oolice at Lyttelton. The Magistrate said that he would place accused on uiobaiion tor twel.e months, and that the money stolen would havi.' to be restored in three months. BARMAN FINED. Wilfred Bates (Mr 0. T. J. Alpexs) was. charged that, Veing a barman, he supplied liquor to intoxicated per£33l. Mr Alpers said that defendant did not partake of intoxicating liqnor himself. and ooictnuUid the offence unwittingly. Defendant had never before charged with a similar offence. A Sue of £'5 was inflicted. BREACH OF ORDER. Joseph Kirn.M' pleaded guilrj- to a (Large cf procuring liquor during the currency ot a prohibition order. Ho was ordered xo come up for sentence vhc-r '.Mlled upon. THBPr. Ikiris Margareita Mc-Kenna pleaded guiitv to a oharco of stealing a ring valued at £S, the property of Chairs Percy Keen. 'She was ordered to come u|- lov sentence when called upon. "Waiter Henry Overton (Mr Onssidy) was charged that, being tho liecasce of the A 1 Hotel, he sold liquor to an intoxicated person, aud permitted drunkenness on licensed premises. Mr Cassidy said that he understood fhafc a conviction would result almcfrt automatically on the first charge, as tho servant of defendant (Bates), had teen convicted. It was merely a risk which every hotel owner employing a barman had to take. A fine of -10s was imposed on tho first charge, the second being withdrawn. maintenance. Thomas Hawkins was sentenced to two months' imprisonment, the order to bo suspended so long as ho paid £1 p<*r week towards tho support of his ivife. Thomas Griffiths (Mr U. rwyneh&m) i was Mied by his wife (Mr Cassidv) for maintenance, separation, and "Uaidinnship. The question of maintenance was held over for. a month. Separation and guardianship were granted. Sicuu-y Sanddrson applied for a variation of a maintenance order against him in respect of his wife. The application was refused. CHINESE AT LAW. Chow Le-r and Co. (Mr Cassidv), Chinese merchants, of Christchurch, claimed from Chong Lee (Mr Mc-. 3>ougall). a Blenheim storekeeper, the sum of £23 9s 7d for goods alleged, to have beon supplied. After, hearing lengthy evidence, for which, the services of an interpreter were requisitioned, the Magistrate nonsuited the plaintiff, with costs, it not being clear how the account now stood. It was left open lor the plaintiffs, however, to call further evidence as to various receipts and cheques produced by the defendant.
