ALLEGED BREACH OF GAMING ACT.

Edward Duller, for whom Mr Malley appeared, pleaded not guilty in the Magistrate's Court yesterday to a charge that he carried on the business of a bookmaker on the New Brighton racecourse on May 16th. Mr H. W. Bishoo, S.M., was on the Bench, and Chief-Detective Bishop prosecuted.' Detective O'Connor said ho saw defendant at the meeting. After the first race four men approached him, after the second race tliroc, a'ter the third race four, and §o on. On each occasion something passed between defendant and his friends, and when the latter left defendant took out a notebook and made some entries. Detective Torrance said the accused was standing on the inside of the track. Ho caw him receive something from six persons, and each time-he made an entry in a book. Detoctive O'Connoll. racecourse detective, said that accused was a bookmaker, and had bben twice warned off the New Brighton racecourse by him on the second day of the races. Defendant said that being a little bit of a sport, and liking some excitement, he could not resist tho temptation to j go out to the ■•trots," especially as it j was a cold, rainy day, ar.d there wae no fish or fruit about—"Mo being a hawker, your Worship.'- Ho backed two consocutivo winners, and on each occasion had shared a ticket with some friends. Ho lost on a third horse. Edward Lloyd said ho know tho defendant, and they had shared a ticket on the winner of the first race on tho J second day of the meeting. Encouraged by this success, he had shared another

ticket with defendant on Admiral Wood ' in the Derby. Tho Magistrate said he w6uld. give tho accused the benefit of tho doubt this time, though he was not at all satisfied with tho case. Another conviction against the defendant would mean gaol, and he advised the man, if he had any regard for his wifo and family, to bo more careful in future. The case was dismissed. ADJOURNED. A similar case in which Edgar E. Neate was tho defendant, was ad- ■ journed until June I6th, on the appli- \ cation of Mr M. Donnelly, counsel for , tho defendant. '
