COURT PROCEEDINGS.
(Received January 30th, 0.5 a.m.) PRETORIA, January 29. When Mr Lucas, counsel for the men, applied for an order restraining the Government, Mr Justice Wcssels declared that ho could not assume, upon mere rumours, that the Government was going to kidnap citizens and deport them, except by Act of Parliament. Mr Justice Mason remarked that he must not bo taken as concurring that the material before the Court was insufficient, and called tho AttorneyGeneral, who declared that he was not aware of the facts. Colonel Truter, replying to Mr Justice Mason, stated that ho handed the prisoners to tho escort under the Government's instructions. Mr Lucas's application for an attachment order was based on the fact that Poutsma and Waterston should have appeared before th© Court on Wednesday morning. Tho application that Mr Smith should be ordered to produce the men was withdrawn on th© ground that the Court was without jurisdiction beyond . the Transvaal.
