ADULTERATED MILK.

c LYTTELTON DAIRYMAN FINED. At the Magistrate's Court, Lyttelton, yesterday, before Mr H. W. Bishop, S.M., Noah Clegge, for whom Mr Neave appeared, pleaded guilty to a charge of having, on November 20th, sold to Richard J. McKenzie a quantity of milk containing water, contrary to "the Sale of Food and Drugs Act, 1908. t Mr Neave said that the analysis of the milk would not be questioned by the defendant, who had bought it from another man. Defendant, Noah Clegge, stated that he bad no cows of his own, and bought the milk from another dairyman, afterwards delivering it to his customers. He sold the milk a_ it was received by him, and did not tamper with it in any way. The Inspector (Mr Kershaw) said that he had no reason to doubt that the facts were as stated by the defendant. In inflicting a fine of 40s and costs, the Magistrate said that it did not matter whether defendant had bought the milk from another man or not. It had to be of a certain standard, and defendant should have tested it to see that it was so. Had he (the Magistrate) thought that the milk had been deliberately adulterated by defendant, he would have fined him £100. On a further charge of selling milk below the standard required by law. the same defendant was convicted and ordered to pay costs.
