BREACH OF CONTRACT.

William CBryan (Mr Neaye), builder and contractor, claimed £26 8s from Thomas Kearney and Herbert i. Atkins (Mr Johnston). It was stated by the plaintiff that on August 4th, 1913, defendants agreed to sell to tho plaintiff 109 cords of firewood then on the premises of Hoskyns, at Upper Riccarton, at the price of 12s a coid. Tho wood was to be removed in nine days' tine, and an extension that might- be agreed upon could be made. By the agreement, the sum of £30 was to be paid on tLe signing thereof, and tho balance was to be paid beforo the second half of tho wood was removed. The plaintiff, it was alleged, duly performed hie part of the contract, but owing to circumstances for which tho defendants were responsible, he was unable to obtain the whole of tho said firewood, and had only rocoived sixteen cords, value £9 12s, for which he gave tho defendants credit. Tho defence was that every consideration had been given" to the plaintiff, who had not carried out his contract.
