MAGISTRATES COURTS.
CIVIL CASESAt the Magistrate's Court yesterday business was dealt with by Mr R. Beetham, S.M. Judgment for plaintiff by default was given in the following:—Booth, Macdonakl and Co. (Mr Bruges) v F. Murphy, £16 7s; the Cyclopedia Company (Mr Flesher) v .E. J. Harrison, £4 12s 8d; same (Mr Flesher) v Benjamin Brooking, £4 13s 6d. P. J. Kelly (Mr TJonnelly) sued G. Vale (Mr Graham) for the. recovery of a blacksmith's shop at Aldington, and arrears of rent amounting to £10 4s 4d. A memorandum of agreement to lease wliioh* was put in was signed only by the plaintiff, and lacked the defendant's signature. The evidence of the plaintiff showed that defendant had been in possession of the shop since June 24th, 1902, the partlysigned lease was for three years, rent payable monthly with right of re-entry to lessor. During the whole time defendant had only' paid rent for one month, and refused to pay more. Mr Donnelly contended that the right of re-eribry lay in the hands of his client independently of the notice to quit. His Worship adjourned further hearing until Thursday. William Parker (Mr Graham) sued Eva Green (Mr McConnell) for £2 13s Id, alleged balance of work done. After hearing the evidence at some length, his Worship characterised the case as frivolous, and gave judgment for the defendant with costs £1 13s.
