JUDGMENTS. ! McLean (appellant) v Waimate County I Council (respondent) was an appeal from a judgment ot the Court below in a caee in which the respondent sued the appellant for trater rates, as occupier of laud through which a race had been constructed by tne Council. Hia Honour now gave judgment, allowing the appeal with £10 10s costs. Mr Franks appeared for plaintiff, Mr Williams for defendant. Hie Honour also gave judgment in xc- Pnrke, a bankrupt, a Timani case, holding that the order of the District Court should be varied by declaring that Lee was entitled to hold the proceeds of the sale of the horeee as against the cum (£160) actually advanced, and received by l'arke on the execution of the sale note; otherwise it ehould stand. No costs were allowed on either side. Mr llyrue and Mr Franks appeared on behalf of the pa i ties to receive the judgment. In Hardcastle v Ctirlett judgment was given that accounts should be taken on the basis uf interest as at. livsl charged. The question of costs stood over pending the result of the action. MISCELLANEOUS. The case of in re Charles Rose and Janet Rose (Mr Dougall), to relieve trustees, stood over on the application of Mr Harper. On the application of Mr Johnston in Rowe v Bishop and others for prohibition, the case was removed to banco, Mi Beswick consenting. Mr Helmore applied in ie G. F. Day for leave to register oopy of assignment. His Honour made tne order. On the application of Mr W. B. Cowliehaw, hia Honour madte an order approving of sureties in re J. L. C Scrutton. deceased. In Skelton v Froetlck and another, an originating summons, the matter stood over, on the motion of Mr Harper. Letters of administration weie granted in Mary E. Ne.ive (Mr BeswickJ. Applications for executors' commission in Rosina Daye (Mr Harper, for Mr Loughrey). William Birdling (Mr Bishop), and Alexander Allen (Mr'Beswick), were referred to the Registrar. In re .Jeaeie Leslie (Mr Dougail) hie Honour made an order appointing the Public Trustee as trustee.
