AN INTERPLEADER CASE. A short time ago Messrs Ashby, Bergh, and Co., obtained judgment against the Peerless Incubator Company for £51 12s 9d. Upon execution b?tog levied on the effects of tlie Company, Mr E. McAlpins, a. member of the Company, claimed the goods as lug own private property, and interpleuded. TLVs dispute a.«j to the ownership was heard before Mr R- Beeiham, SM., ytsteiday. Mr Byrne appeared for McAlpim-, and Mr Cowiishaw for the Company. His Worship, after hearing the evidence, said that to his Judgment all the things claimed belonged to the Company. McAlpine's theory iras that all the things belonged to him, ar.d that he allowed the Company to use them. Hβ did not believe one syllable of what Mr McAlpine had said, and the interpleader claim would be disniis!*^d. HORSE STEALING. A young man named William Murphy appeared upon a charge of stealing a hor.«e, saddle, and bridle, valued at £28 14«, tht> property of Jamea Leary. Mr Casaidy, for I Mr Rom&L appeared for the accused. * The j evidence for the police was to the effect, that ■ the accused had borrowed the fiorse from I Leary outride Tattenaliy He did not ! retiirn it, but two day» later sold it to a Mr Jamee Walker, of Dunfandel, for £7. tb*t he bad bought it niiw months previously. Walker aftenvurd* sold ths horse to a ifr J. Wood for £4 10i. Th« acciued ira« arreAted at. Timaro by CoaeUbie Perniskie, to wham he admitted the theft, adding that he itw eoft in the head. Murphy pkaded "Guilty" thLV ntomiog, and was committed to the Supreme Court for eentnice. Bail was fixed at two eurotics in £100 eaoh.
