(PRESS ASSOCIATION TELEQBAM. ) WELLINGTON, October 15.

In the Appeal Court argument is being heard in the case of Smitas Company, Limited, v Ogle, of Auckland, manufacturer of pumice soap, &c. In this action, which is an appeal from a decision of Judge Conolly, the appellant seeks to restrain tho respondent from using the word " sanitas " as an infringement of his trade mark. In the previous case Mr Justice Conolly said the use of the word by the respondent was not calculated to deceive the public that the articles sold by the respondent were those manufactured by the appellant Company, and gave judgment for the respondent.
