Damages To Plaintiff In Motor Collision Case

Taking the view that the defendant was, in a sense, “hogging” the road, the Magistrate gave judgment in favour of Dr. R. N. Akel (Mr Hodgson), who sued N. H. Parkinson (Mr Otley) for £3B 6s 2d damages arising out of a collision on the Ohope hill on July 8 last year. Costs, £6 7s, werp also awarded the plaintiff. Evidence showed that Dr. Akel had been to Ohope and was returning when his car collided with the defendant’s truck, which was coming slowly out of the Gorge road intersection. Plaintiff cfeimed that it stopped halfway across the intersection and he could not pass either behind it or in front of it. Defendant alleged the Doctor’s car was travelling too fast.

The Magistrate said the defendant’s estimate of the plaintiff’s speed was absurd, and that he (defendant) was in a sense “hogging” the road in that he was travelling too slowly and dwelt too long on a dangerous spot.
