BRICK BY-LAW STANDS

EDGECU MBE THEATRE CONTROVERSY

The notice of motion put forward "by Ci" Smith at the meeting of the Whakatane County Council, that the by~ laws governing the 'brick area* at Edgecumbe be waived urtil after the war, failted to move the Council from its original decision and once again the position covering the building of the proposed new picture theatre at Edgecumbe standls and there can be no departure from the brick or ferro-concrete structure required by the by-law.

Before the matter Avas opened for discussion a letter was received from Mrs H. M. Walsh of Edgccumbc, protesting against the suggested variation on the grounds that it should he either a permanent removal or until five years after the war to enable the. men returning home to compete on a similar basis. Gr Smith once again repeated his former arguments, complaining that the standard aimed at under the. bylaw was far too high td enable any small businessman to get established. He mentioned the poor treatment which Avas being experienced by the pioneers of the township and contended that the by-law was premature and harsh. He moved formally that it. be suspended for the duration^ Cr Hunter in seconding said that the people whilst not desiring uncontrolled building would be perfectly happy with rough caste structures. There were, he had been us-* sured, several persons awaiting the outcome of the present move to see if they would build or not. Gr McCrackcn opposed the motion pointing out that if the by.,l laws were waived the Council would be permitting the. construction of a largo public building right in the heart of the Edgccumbc business area. Whereas rough caste was fireproof outside, the wooden interior held all the lire risks which they were trying to avoid. Grs Luxtori, McCready, Butler and jtfcGougan also spoKc against the motion, Mr J. I- Burnett said, he was glad to note the course of the debate- The by-law had been named as a hardship to certain persons but he i>referred to view it as a protection for the general public in the interests of the district as a whole. On being put to the meeting the motion was lost, by seven votes to three. /
