REMEMBER MARCH 4th EDGECUMBE GYMKHANA Watch for programme of events" 12a WHAKATANE BOROUGH COUNCIL Notice is hereby given that at a Special Meeting of the Whakatane Borough Council held January 17„ 1044, the following resolution was, passed and will he submitted for confirmation at the Council Meeting to be held February 14, 1944 at 7.30 p.m. at the Borough Council Chambers, Whakatane. RESOLUTION. In pursuance of the powers and authorities vested in it by the Municipal Corporations Act, 1933,. the Cemeteries Act, 1908, the By-Laws. Act, 1910, and all Acts amending the same respectively and of all and each of every other power and authority thereunto in that behalf enabling it tlw Whakatane Borough Council, acting on behalf of the Mayor, Councillors' and Burgesses of the Borough of, Whakatane, doth hereby by Special Order make this By-Law. The purport, of the resolution is to repeal all ex* isting By-Laws relating to the. Whakatane Cemetery, and to make a new By-Law with respect to this cemetery and the new cemetery at Mokorua designated the Whakatane Hill Cemetery, generally concerning the management and control of sueh cemeteries, and prescribing fees for the purchase, of plots and the burial of the dead. A copy of the proposed. By-Law is deposited at the office of the Council, Whakatane,, and may be inspected during office hours and without lee until February 14, 1944. D. V. SAUNDERS, Town Clerk. Tenders shall be in writing addressed to The Chairman, W-hakaw tane Harbour Board, AVhakatane and marked on outside "Tender for Lease" 2. Tenders shall close on Wednesday the. 2ncl February,, 1911. The highest or any tender Avill not necessarily be accepted. 3. Within one month after acceptance of tender the lessee shall execute a lease in conformity with the subjoined conditions which lease shall be prepared by the Board's Solicitor and the costs thereof shall be paid by the lessee. Material Contents of Lease 1. The lease shall be for a term of 14 years with a perpetual right of renewal for terms of 14 years each in accordance with the. provisions of the Ist schedule of "The Public Bodies Lease Act 1908" 2. The lessee covenants to pay rent half yearly in advance and all rates and taxes, to refrain from offensive trading, to repair and maintain to make sanitary installation, to erect a building of at least value of £2000 within one. year and not to assign lease before such erection. 3. The Board reserves the right to alter,, defer or abandon any of its proposals of roading, rights of way, access, reserves or works of any kind not yet carried out. 4.A draft of the lease may be inr spec ted at my office, Whakatane.
