OIL FUEL SOLD
CONTRACTU!: PROSECUTED
Charged with illegally selling twelve gallons of petrol obtained from his current license, Francis George Mahy, a contractor of Whakatane, for who Mr G. Otley appeared pleaded guilty at the Whakataine Court; sitting last Tuesday.
Sergeant Earrell said that defendant was contracting north of Auckland when the offence took place, Mahy supplying the benzine to one of his employees for the purpose of enabling him to motor home to Auckland when he had .completed his employment. The employee concerned had already seen the authorities who agreed to allow him sufficient petrol to go to Otira and from there to rail his car to Auckland. This however he had not done.
Mr Otlcy explained- in defence that under the Carpenters Award it was necessary for an employer to see that his men were returned to their homes on the expiry of their Avork. Mahy had' also used the employees car in connection with the job and to this end felti that he was entitled to compensation. It had therefore been arranged to supply him with six gallons by way of compensation and another six, in order to see him home the 1 rest of the distance from Here'kino. Counsel suggested that it was more a technical breach than an actual olfenee and, added also that Mahy at the time of the arrangement was Unaware of the fact, that his employee had already applied to the authorities. Fined and costs 325.
