There was only a very short list of cases to be heard by M)r E. L. iWaltori, S.M., when the monthly sitting of the Whakatane Magistrate's Court was held yesterday.

For having operating' a radio receiving set without being the holder of a licence H. Hohia >vas fined £1 with costs 225.

A similar offence cost - Samue Hohua £1 with court fees 235.

The Transport Department proceeded against Cecil T. Plank for •operating an unlicensed passenger service. Evidence was given to the effect that the offender had taken passengers in his car and had charged separate fares instead of taking the party by contract. A fine of -£1 with costs 12s was imposed.

Hugh Ol Eatterson was charged with an unlicensed tractor amftrailer. The Inspector stated -'that the vehicles were for farming purposes and had been found in use •on road. Such vehicles when uised for only f&rm purposes were liable for no fees other than the Third Party Risk.

The defence entered a plea of ;;guilty but pointed out that the defendant had had no idea an offence -would be committed. He had been to take spoil from the roadside and had expected his employee to approach the dump from ■ a nearer gateway where no travel by Toad would have been entailed. Both vehicles were fitted with pneumatic tyres and no damage had been caused to the road.

On the first charge a fine of 10s T \yith costs was imposed, while the • charge in connection with the trailer entailed 10s costs only.

For operating a truck and trail-* •er, neither of which carried a certificate of fitness, cost the Ujpanga 'Sawmill Company £1 with costs £1. A fine of 10s with costs 12a was imposed on Carl Hyland for a similar offence. Civil Cases. ' Judgment Summons. #- Cadman's Pai-king Station v Tata Maui, claim £2 10s. Ordered to pay owing, in default two days in Whakatane Police gaol. Eden Motor Co. v C. E, Tassell, ■ claim £3 13s fid. Ordered to pay -amount owing, in default three days in Whakatane Police gaol.
