PUBLIC NOTICES COUNTY OF WHAKATANE NOTICE OF SPECIAL ORDER' MAKING BY-LAW Public noticc is given that a meeting of the Whakatane County Councill will be held at the Council Chambers, the Strand, Wliakatane, at 11 a.m. on Tuesday, 19th November for the purpose of confirming a resolution passed by way of Special Order at a special meeting of the Whakatane County Council held on 22nd day of October, 1940, making a By-Law to be known as "The Whakatanc County Council Ohope Beach Motor Vehicle By-Law, 1940," v4z:' IN PURSUANCE and exercise of the powers and authorities conferred upon it by "The Counties Act 1920" and "The Motor Vehicles Act 1924" and the amendments of those Acts respectively and of all other powers and authorities it in this behalf enabling, The Whakatane County Council DOTH HEREBY by this Special Order MAKE AND ORDAIN the following By-Law—that is to say— (1) IN this By-Law unless inconsistent with the context the following expressions shall have the meaning hereby assigned to them: — "The Council" means the Whakatane County Council. "Motor Vehicle" means any veliicl? that is drawn or propelled by mechanical power and includes a motor cycle. "Ohope Beach foreshore" means all that the sand beach and/or foreshore at Ohope in the County of Whakatane which is under the control and management of the Council and extends from the cliffs at the Western end of the Ohope Beach in an Easterly direction along the said beach to the mouth of the Maraetotara Stream, and down to low-water mark throughout the full length thereof. Words importing the singular number include the plural and vice versa.. (2) NO person shall drive or ride any motor vehicle on, over or across or along the Ohope Beach foreshore or any portion thereof at a greater speed than TWENTY MILES per hour. (3) NO person shall drive, ride, haul, take, leave or park any Motor Vehicle upon, over, across, or along any portion or selected area of the : Ohope Beach foreshore which the Council may at any time and from time to time by Resolution declare for any purpose, or for any special function or for any spbeial period or periods to be a prohibited area for Motor Vehicles, at any time while such prohibition shall be in force and cft'ect and shall be publicly notified by Sign or Notice , erected and/or placed on, at or near to, or at the entrance of, such prohibited area. (4) EVERY' person committing a breach of this By-Law shall for each' such breach be liable to a penalty not exceeding Ten pounds. G. G. LUCAS, County Clerk, 122 22/10/40.
