PUBLIC NOTICES COUNTY OF WHAKATANE NOTICE OF SPECIAL ORDER) MAKING BY-LAW Public notice is given tliat a-ineet-'-ing of the Whakatajie County Coun-: cill will be held at the Council s Chambers, the Strand, Whakatane, »t 11 a.m. on, Tuesday, 19th Novem- * ber for the purpose of confirming resolution passed by way of Special' Order at a special meeting of the- ' Whakatane County Council held on 22nd day of October, 1940, making By-Law to be known as "The Whakatane County Council Ohope BeachMotor Vehicle By-Law, 1940,"' viz:, IN PURSUANCE and exercise of ther powers and authorities conferred upon it by "The Counties Act 1920" and "The Motor Vehicles Act 1924"" and the amendments of those Acts respectively and of all other powers ■ ■ and authorities it in this behalf enabling, The Whakatane County Council DOTH HEREBY Special Order MAKE AND ORD&JN the following By-Law—that is Jo say— (1) IN this By-Law unless incon-< sistent with the context the follow-* ing expressions shall have the mean-<" ing hereby' assigned to them:— "The Council" means the Whaka--tane County (Council. _ "Motor Vehicle" means any vehicle ■ that is drawn or propelled bjrmechanical power and includes::' a motor cycle. . , "Ohope Beach foreshore" means that the sand beach and/or foreshore at Ohope in the County of Whakatane which is under the control and management of theCouncil and extends frtnn the cliffs at the Western end of the Ohope Beach in an Easterly di->- . rection along the said beach to the mouth of the MaraetotaraStream, and down to low-water mark throughout the full length • thereof. (2) NO person shall drive or ride any motor vehicle on, over or across or" along the Ohope Beach foreshore or any portion thereof at a greatei' speed' than TWENTY MILES per hour. - (3) NO person shall drive, ride, haul, take, leave or park any Motor Vehicle upon, over, across, or along any portion or selected area of the v Ohope Beach foreshore which the Council may at any time and from, time to t.ime by Resolution declare for any purpose or for any special function or for any special' period or periods to be a prohibited area * for Motor Vehicles', at any time while such prohibition shall be in force and effect and shall be publicly notified by Sign or Noticeerected and/or placed on, at or near - to, or at the entrance of, such pro--hibited area. v ■ (4) EVERY person committing a: breach of this By-Law shall for each.- * such breach be liable to a penaltyi~ not exceeding Ten pounds.
