NOTICE OF MOTION

RESCISSION OF RESOLUTIONS OHOPE SWIMMING POOL. AGAIN 1 Once more the question of aj swimming pool at Ohope was considered by the Whakatane County Council, when, at yesterday's meeting two letters were received from Mr F. Mahy . Senr. asking for a reconsideration of the proposal by the Council, which, at previous hear ings, bad decided not to assist. After discussion by the Council notice of motion moving the rescission of the Council'is previous resolutions was tabled by Cr McCready.

The first letter'from Mr Mahy requested that the Council view the proposed Learn to Swim Pool at Oliope in the light of public utility .and children's health and safety, lit was further stated that the fact of the pool being built at Ohope would not limit its usefulness as it would be in full use during the sunt mer holidays and partly through the rest of the season, whereas if .the pool was constructed near the central School in Whakatane it would have to be closed for seven weeks as teachers would not be in -attendance. The writer added that ■he had agreed to find a sum suffi- • cient for the maintenance of the pool for five years. If the council sanctioned the erection of the pool an endeavour would be made to collect money for a board fence to ensure security against accident when ■the pool was not in use, as a projection from wind and to, enable .children's swimming carnivals to be held in aid of County Patriotic ■Funds. :r The Works Committee's recommendation', was that the Council .ad-, vise Mr 'Mahy that it had nothing io add' to its letters to him dated .February 28tli, and March 20th, of .this year. •Cr McCready said that in view of the position to-day the Council ought to be more generous. flit, scheme would." not cost the ratepayers anything apd of the . opinion, that , the Council , should give the matter more favourable .consideration than it had dohe in .the past. Opposition was forthcoming from Cr- Luxton. who said there would be no advantage in a project 'poked away in one corner of the County.' If accidents occurred the sky would be the limit for compensation claimed from the County Council and he did not see why the Coun cil should bear the responsibility. The Chairman was of the opinion that if Mr Mahy built the pool on his own secti-on it would relieve the v*' Council of any responsibility. All : sympathised with the promoter of the scheme, Mr Burnett said, but he did not realise, the' responsibility placed on the Council. Cr McCready said that recently a child was drowned in the Waikato district but he had not yet seen a claim for compensation. He added that he would like to see the position cleared up by proper legal advice. A caretaker '-would be necessary, said Cr Luxton. If a pool was required, why not have it in a central position? How many people -went to Ohope during the seven weeks mentioned by Mr Mahy compared with those in other parts for the other live months? Cr McCready said he would like to hear reasonable reasons for op"osing the scheme. The Ohope ratewere behind it and would after it when established. Another Councillor who thought Mr Mahy deserved credit was Cr McGougan. He added, though,, that in his opinion, the place for a Learn to Swim pool was in the Borough. A pool in Whakatane would be a great thing. Further and lengthy discussion resulted in Cr McCready giving notice of motion that he will move, at the next meeting of the Council, that the previous resolutions not favouring the Ohope swimming pool project be rescinded.'
