CHARGE DISMISSED

"lii this case I have to ask myself, 'Would a jv,ry convict defendant?' They would not and I don't propose to either.' This was the manner in which Mr ,W. H. Freeman S.M. dismissed a jcharge of theft which was brought Against Stanley Evans in the Police Court on Wednesday. Constable Fuller said that he had interviewed defendant and produced a statement made by him. Tn this the defendant stated that he had been employed by the Public Works Department on a painting job. He had used his own brush for the "work and the rough nature of the timber had worn away the hair of his brush until it became useless for painting. He had been issued with a brush by the Public Works Department for the one particular job and as he had "used his own and completely worn it out, he had kept the Government "brush. Constable Fuller added that defendant had been very frank about the matter and had considered that he was quite justified in the attitude he adopted. Constable H. Hedley said that he liad been instructed to bring the ■charge as a warning to others. The Magistrate then dismissed the 'case.
