THEFT CHARGE DISMISSED

MAN TO JOIN ARMY

A pi ea for dismissal of the charge under the Justices of the Peace Act and for suppression, of his client's name was successfully made by Mr B. S. Barry, appearing at Whakatane on behalf of a 25 year old man who pleaded guilty to theft, counsel stating that his client had joined the army, and did not wish to begin his service under a cloud. The presiding justices, Messrs G. A. Brabant and R. J. D. Brown,

granting the requests, warned the young man to keep out of trouble in future.

The justices heard the case in the absence of a magistrate,* Mr E. L. Walton S.M. being on sick leave, and Mr J. H. Luxford S.M. not being available. The charge concerned the theft of a bottle of ether and two dozen bandages, of a total value of lis Gd, from the Whakatane Hospital Board on July 5.

Accused had enlisted before the commission of the offence, and had been held over on account of slight dental trouble. He would go with the next draft. Mr Barry said it was not a case of a: man asking to be dealt with leniently and promising to "enlist. Counsel asked for the charge to be dismissed under the relevant section of the Justices of the Peace Act. A conviction would do nobody any good and leniency would m-an that the boy would go into camp with his record unsullied. Mr Barry intimated that the court costs would be paid. Mr Brabant said that the court would take a lenient view of the case but the young fellow should take the warning. The ehargo would be dismissed.
