MILK SUPPLY
QUESTION OF QUALITY £59 DAMAGES CLAIM A ease of considerable interest to borough householders was held in the Magistrate's Opotiki, before Mr E. L. Walton, S.M. A. C. Butterworth (Mr N. V. Hodgson)' sued A. and R. Tew (Mr B. 'S. Barry, of Whakatane) for £15 10s 8d for milk supplied in October 1938. A. and R. Tew defended this cla'm on the ground' that the milk supplied them was deficient in butterfat was unfit for human, consumption and was not of merchantable quality. On the same grounds they claimed £50 damages from Butterworth, al : leging they had lost customers through the bad milk supplied. At the conclusion of 'few's- evidence, Mr Hodgson asked for a nonsuit or for judgment for Butter, worth on the ground that there was no evidence in support of Tew's, allegations. The Magistrate, without calling on Butterworth to give evidence, gave judgment for Butterworth in both cases, with costs totalling £17 6s 6d on the ground ''that that part of the evidence for the Tews which might be true Avas too vague, and the lest of it was incredible.*' -
