The Court said that a strong case was tnwile out for the plaintiff, until the deftndfint'* evidence was heard, but as It was possible that., plaintiff and his witnesses might be mistaken in tbe horse, whereas the defendant swore that the horae tied to the fence, belonged to a Mr Home, and the Court coald not suppose that, defendant was perjuring himself in so swearing.
