(Before Herbert W. Brabant, Esq,, E.M., and F. E. Hamlin, Esq, JJP.) A. Cook v. J. N. Nicholson. Claim, £10 18b 6d. There was no appearance of defendant. The ca&e was adjourned until next Court day (Nov. 1) to find out before whom the affidavit of service of summons was Bworn in Dunedin, as tbe signature was illegible. Thursday, October 26. The mas Corbett was charged by the District Engineer, Captain Turner, with unlawfully arid wilfully destroying, displacing, or altering the position of trigonometrical Rtation D, ! situated on land in possession of the defendant at Judea. ■ The defendant did not admit the charge. Mr Quintal, appeared for the prosecution. ' After hearing the evidence for the prosecution given by Captain Turner and Messrs Goldsmith and Connell, of tbe Survey Departi ment, the Court gave its opinion that Jno evidence had been brought forward to connect the. defendant with the destruction of the station, or that he had wilfully destroyed it, and would therefore dismiss the oase. The Court remarked, however, that though tbe present case had not been made out, the object | of the prosecution would probably be gained by letting the publio know that the trigonometrical stations were of great importance, and might be required at any time, and that any person wilfully destroying any of them was liable to a penalty of not less than £50, though there waa nothing in the Act to show that occupants of land upon which the stations I vrero erected Were obliged to keep them in j repair.
