TT is hereby notified, with respect to the Confiscated Lands on the 'West Coast, advertised in the JStew Zealand Gazette , No. 4, of the 29tb January, 1874, to be sold by auction at the Court House, Patea, on the 12th day of March, 1674, that they will be sold subject to the following conditions ; From and out of any of the said lands it shall be lawful for the Governor, or any person appointed by him, at any time after the sale thereof, to take and lay off, or cause to be taken and laid off, for public purposes, one or more lino or lines of road, railroad, or tramroad through such land without payment or compensation..; Provided that the total quantity of land that may be taken for such line or lines of road, railroad, or tramroad under the said power shall not be more than after the rate of five acres in every one hundred acres, and so on in proportion for anj greater or less quantity than one hundred acres, and whether the parcel of land sold be greater or less than one hundred acres. The Governor may at any time by indorsement on the grant, or on a subsequent instrument or disposition, or by separate deed, release any such right, and discharge the land comprised therein from the said liability. Nothing herein contained shall authorise the taking of any lands which shall be occupied by any building, or by gardens, orchards, plantations, or ornamental grounds. The said power of taking lands for roads, railroads, and tramroads shall cease and determine at the expiration of five years from the date of the sale. O. A.
