WATERSIDE ACCIDENT
VERDICT FOR PLAINTIFF
The claim by a waterside worker, Arthur George Smith (Mr. Sullivan) against the Union Steam Ship Company (Mr. Hamer) for £267 special and £750 general damages arising out of a shipping accident, which had been three days in hearing before Mr. Justice Fair and a jury, concluded in the Supreme Court yesterday afternoon in a verdict by the jury for plaintiff in four of the five issues submitted to them. The jury agreed that the accident had been due to negligence on the part of the company's servants in making up a sling concerned in the accident, that a protest by plaintiff had been overruled, and assessed damages at £450 general damages in addition to the special damages agreed on. But the jury could not agree on whether there had been contributory negligence on the part of the plaintiff. Mr. Hamer was granted ten days In which to move for a new trial.
