CLAIM FAILS.
A DRIVER'S ACCIDENT. Judgment was given to-day by Mr. Justice O'Regan on the claim* for" compensation by A. \V. Hawkins, horse driver (Mr. Haigh), against A. B. Wright and Sons (Mr. West), arising out of injury to an ankle when claimant slipped from the running board of a motor truck on the wharf. At the time of the accident claimant had left hie team on the -wharf and was on his way to purchase his lunch before returning to his team. Plaintiff claimed that the accident resulted from his attempting to get on the motor truck to avoid another truck, and that it arose in the «ourse of his employment. The defence was that claimant's abortive attempt to jump on the running -board of the truck was merely for the purpose of having a ride. His Honor found that the accident arose from an action not connected with the plaintiff's employment, and that his claim for compensation must fail. Judgment was given accordingly, leave being reserved to ths defendant company to apply for costs.
