INDUSTRIAL APPEAL.
CASE FROM KAIKOKE.
An appeal by the inspector of awards Uhangarci, against the decision of a. magistrate in the case inspector of ?£ ard «> V: Geor S e J e<-kovich, Kaikohe (Air. Wylie, Whangarei), was heard by the Arbitration Court to-day. Mr. Justice Tyndall presiding. r .Jf°J * he ai'Hl»"'t, Mr. C. B. Smith, thief Inspector of Awards. Auckland said that the Whangarei inspector claimed £10 penalties from respondent, alleging breaches of the tearooms and restaurant workers' award in the matter of wages, time-book and other matters respecting a female emplovee. The magistrate found as a fact," on the evidence, that the young woman was employed in tearoom work, but this work occupied considerably less than 50 per cent of her time. * Consequently, holding that the worker \va~ not substantially employed as a tearoom worker, the magistrate found for defendant. Mr. Smith added that the tearoom in question was a small one, having onlv hve tables. The evidence showed that the employee regularly washed and scrubbed the floor of the room, washed tne tablecloths in conjunction with the rest of the family washing, and similarly washed up the dishes from the tearoom as well as the household dishes, inis, he claimed, brought her within the scope of the tearoom award in respect to hours and wages. He cited decisions in cases which he claimed to be on parallel lines. «f A * echn «!« l Pojnt alleging insufficiency of the notice of appeal, raised by Mr. Wyhe, haying been reserved by the Court, counsel emphasised that the irirl concerned did not work after 1 p* m She was employed a* a domestic, and in washing tho floor of the room and occasional disnes in the family wash-up she performed but an infinitesimal portion of the tearoom work. The inspector's claim, he argued, was trivial. (Proceeding.)
