LIQUOR SELLING CASE.
APPEAL BY CONSTABLE.
MAGISTRATE'S DECISION CHALLENGED.
(By .Telegraph. —Press Association.) WELLINGTON, this day. The Full Court, consisting of the Chief Justice, the Hon. M. Myers, and Justices Herdman, Adams, MacGregor and Ostler, is engaged to-day in hearing the , appeal of Edward Frank Smith; police constable, of Nelson (appellant) against Keith Hiskson, licensee of the Koyal Hotel, Nelson (respondent). Three informations were laid in June against respondent by appellant, alleging that on April 27, 1929, respondent, being licensee of the Royal Hotel, Neieon, did at a time when such premises were directed to be closed by the Licensing Act (1) sell liquor in such premises, (2) expose liquor for sale, (3) open the premises for the sale of liquor. The informations were heard at Nelson on June 10 before Mr. Mauusell, S.M. Respondent pleaded guilty to the first information and was fined £2 2/ and costs. The magistrate held that ths opening for sale and exposing were part of the transaction of the sale upon which respondent - had been convicted, and, accordingly, dismissed the two latter informations. Appellant is appealing on the ground that the magistrate made an erroneous decision of law in dismissing these* two informations. Mr. C. It. Fell appears for appellant, and Mr. W. Perry and Mr. S. H. Moynagh for respondent. Argument is proceeding.
