KEEPING ACTION ALIVE.
SUSPENSORY ORDER MADE. INJURY TO WORKER'S EYE. With the object of keeping the action alive pending an operation to his right eye, which had developed a cataract following an accident suffered in the course of his employment with Radley and' 00., Ltd., merchants, of Auckland, a suspensory award was made at the rate of 14 • week in favour of Michael Haller, storeman, of Auckland, who instituted a claim for compensation in the Arbitration Court this morning. The facts of the case were that HalTsr had his right eye injured on October S last by a nail which he was using on a boxx at tlie city markets flying upwards. This had caused a traumatic cataract, which had destroyed nearly all and would destroy the remainder of the eye. He continued work till March «28 last, when his services were terminated. He was disabled from earning wages, according to plaintiff's statement of claim, and he therefore claimed compensation from the latter date up to the present at the rate of £3 a week, and further reasonable Telief. Mr. J. J. Sullivan for plaintiff asked that a suspensory order be made in view of the fact that Haller would have to submit to an operation, when the ease came up for hearing. Mr. E. H. Northern ft said counsel were advised by a medical expert that Haller l would be unwise in his own interest* not to submit to an operation. The defence was willine to submit to a declaration of liability. Mr. Justice Frazer said the fair course would be to make a suspensory order, which would keen the case alive so that the matter could be brouaht on at any time on the motion of either side.
