COMPENSATION CASE.
1 « ACCIDENT AT GRAFTON. WORKER OBTAINS EXPENSES. At the Magistrate's Court yesterday afternoon, Mr. E. C. Cutten, S.M., was engaged in hearing a claim for worker's compensation brought by Charles Gunn I (Mr. J. J. Sullivan) against W. F. Blanchard (Mr. G. P. Finlay) for damages arising out of an accident that occurred on October 25, 1927, whilst Gunn was engaged in the erection of a motor garage at the corner of Park Road and Park Avenue, Grafton, he being struck on the stomach by a plank, portion of a scaffolding, which he was shifting. This occurred at about 4 p.m., and he continued working on the following day, but on the second day as he was going home after work he collapsed in Karangahape Road, and was taken to the Auckland Hospital, where he was operated on, and owing to some complications made slow progress towards recovery. Worker's compensation was paid until March, 1925. Owing to a dispute as to the extent of the liability, proceedings were instituted in the Arbitration Court before Mr. Justice Frazer, and by the consent of the parties, the matter was submitted to Mr. Cutten, S.M. The Magistrate's Court yesterday resembled a scene at the Arbitration Court, as five doctors were present to give evidence. When the case was called, counsel intimated that the main question was a conflict of medical evidence, and it was suggested that the doctors should confer to see if it was possible to arrive at any satisfactory conclusion. Having conferred, they submitted their finding to His Worship Legal argument arose, and afttr hearing counsel Mr. Cutten awarded Gunn £60 costs and medical expenses.
