IN BANCO. ■:• <■'<'■■ ! f A sitting in banco was begun at the Supreme Court yesterday afternoon before Mr Justice Dennistbn. •Re the Patetnt Designs and Trade' Marks Act 1889 and re removing the registered trade mark of Johann Anton Bock. Gounsel appearing in the case announced that a settlement had been arrived at, and. an order a3 to costs was consented to.
Mr R. MeV<eagh applied for a writ of mandamus cSreeting Mr C. C. Kettle, SjM., to hear and determine the case of Robert Kerr (fireman) v. Makolm G. McGregor a& -exeeutbr and trustee of the will of the Mc William A. McGregor. After lengthy legal argument, his Honor said that he thought the magistrate took a proper view of the Act, and dismissed the application. > ,;.'.,-.
The Court then adjourned until this morning.
TO-DAY'S PROCEEDINGS.
McCAUL V. MASON.
This was an application for the interpretation of the -will of the late Walter A. McCaul, which provided that his estate should be divided -into seven parts in such a manner that, the: share of Walter and. Benjamin (two of the beneficiaries) should be two-thirds less than the share of, the pther beneficiaries. •
Mr Reed appeared for the appellant Mr C. J. Tunks appeared on behalf of the lady beneficiaries (five), and Mr Clayton for ..the remainder. - ~.;■- , Counsel signed the .matter at lengUL , and his Honor reserved decision.
