At the Raglan Court on Tuesday last, before Mr Northcote, a bush contract case, David Vercamer v. Earnest Augustus Foster, was heard, in which the former su?d the latler for £BS, balance alleged to lie due on account, af a hiishfrlJlnsr contract. Plaintiff said the contract was to clear 200 acres more or less at Pakihi. at £1 3/ per acre. An agreement tv.ts made in writing between them. Patches of bush ivere left for shelter. Defendant paseed the work at the end of July, but it was October when he. said be was jroins to make a deduction for the shelter patches left uncut, and also to make plaintiff cut a number of trees that were standing. Tho defendant said no went over the work several times, and each time complained of the work clone. He bad not passed the bush, or eaid that the work was done to his satisfaction. In reply to the magistrate, witness said he knew \ erenmor was discharging his mra, but us it was Vercamer'6 look out the work was not done properly, he did not say anything about his not passing the contract. Hi! told the men that if there was danger in cutting the trees they could leiive wfm. His Worship said from the written agreement it appeared that the contract was to bo done to the satisfaction of defendant, ir he hart any complaints they shonlrl have be.!>n done before plaintiff discharged Ills men, Instead of which plaintiff had paid the men to dear himself of liability under "The Contractors Liens Act.' , Judgment was Riven in plaintiff's favour for £86 7/, and costs £3 12/0.
