(Before F. D. Fenton, Esq., Acting District Judge) JOHN REID V. C. AND G. CLARKE. , I Claim £25 lis 6d. Mr. Bennett for plaintiff, and Mr. Rees for defendants. This was an action brought by plaintiff, of Auckland, against the defendants, shipping I chandlers, of Port Chalmers, for commission and brokerage, and the procuring of a charter for their brig, the "Thomas and Henry." J

The defendant denied the claim as set forth in particulars. Mr. Randolph A. Lush, of the telegraph office, produced the telegrams which had passed between the parties. John Reid, commission agent, of Auckland, deposed that he acted as agent for Clarke and Son of Port Chalmers, and procured a charter for their vessel according to telegraphic instructions from the defendants.

The case turned principally upon the question whether a telegram was legal evidence of contract. After the various witnesses had been examined the court non-suited the plaintiff.
