AUCKLAND IMPROVEMENT COMMISSIONERS V,

WILLIAM GILL AND TWO OTHERS

Claim £100, trover.

Mr Lusk, for the Commissioners, said that this case had been heard on a previous day, but the decision was reserved by the late Mr Beckham, but his decision, if arrived at had not been made public; the Commissioners had done all they could in the matter. His Honor said he was not in a position to give judgment. Mr J. B. Eussell said the case must lapse. The case was allowed to stand over for the present.

AY. J. CAWKWELL V. JAMES FOLEY. Mr Laishley for plaintiff. Mr Cawkwell deposed to the debt, which was still owing on a deed of mortgage. Judgment for plaintiff. Costs, £8 16s 6d. - WM. M'COMMONS V. R. H. BARTLETT. Claim, £23 17s 3d. Mr Hesketh for plaintiff. This wa3 a, claim, for goods against defendant, who did not appear. Judgment for plaintiff. Coats, £4 Bs.

NATIONAL BANK OF NEW ZEALAND V. "WINDSOR CASTLE GDLD MINING COMPANY.

Claim £70 13d 9d, balance of account. Mr Hesketh for plaintiff. Edward Bransley Nation, ledgerkeeper of the bank, deposed that the Windsor Castle Gold Mining Company had since paid £27 9s, leaving still due £43 4s 9d. No appearance on the part of defendant. Judgment for plaintiff. Costs, £3 5s 6d. T. M. MASEFIKLD V. PETER SOBRE. Claim £37 Is 9d. Mr. J. B. Russell for plaintiff. George Bennett Jones proved that the debt was still owing, as stated in bill of particulars, less £4. Defendant admitted the debt. Judgment for plaintiff, costs £4 15s.
