SUPREME COURT.—This Day.
IN BANCO. (Bafore His Honor Sir Geo. A. Arney, Xt, Chief Justice.) DUDER Vi RICHMOND, DEMTTRR.ER. Mr MacCormick appeared for the defendant in support of the demurrer, and Mr Rees for the plaintiff. Mr MacCormick in opening the ease stated the attendant circumstances, which were as follow :— . An action for £500 damages, for false imprisonment, had been brought by the plaintiff against the defendant. The declaration set forth that the defendant, acting as solicitor for one Geo. Beddoei, had on the 14th December, 1872, assaulted and caused to be assaulted, and wrongfully imprisoned the plaintiff. To that declaration the defendant replied that the arrest wo duly made under process on a writ of ca. ta. Plaintiff admitted judgment and issue and service of writ, but contended first that there were certain circumstances known to the defendant which rendered the service of the writ .unjustifiable. Secondly, that the writ of ca. ta. had been set aside by the Judge of the Supreme Court, and at the samo time ■et forth the groundshipon |whick the order had been made. Mr MacCormick, in a long technical address, which would be uninteresting to our leaders, demurred to both grounds of the replication.,. ■
