DISTRICT COURT.—This Day.
(Before His Honor Judge Beckham.) HOWARD V. HICKS. Claim, £25. Mr Alexander appeared for plaintiff, and stated the nature of the claim, which was for use and occupation. Joseph Howard proved the debt still due Judgment for plaintiff. Defended Case, george tofp v. \ym. kelly Claim, £49. Mr J. B. Russell appeared for plaintiff and Mr Alexander for defendant. ' This was a claim for charter and freight. Mr Alexander confessed judgment. Mr Russell informed the Court that this claim was for freight and charter of a small craft from Tairoa-to Auckland, and he would ask for immediate execution. The debt had been standing for six months, and plaintiff had been subjected to great annoyance by defendant, who was a member of the General Assembly. Mr Kelly was iirst at Opotiki, then at Wellington, and defendant had even been to Napier in quest of defendant, but found that he just liitted to other scenes. Plaintiff might have detained the goods, but considering Mr Kelly to be a man of honor he placed implicit confidence in him. He thought defendant's evasive conduct did not entitle him to any consideration from the Court. If Mr Kelly was not a lawyer he was a law maker, and. could distinguish between right and wrong.
His Worship hoped that Mr Kelly was not quite so bad as he had been painted, and as there was a cross-action pending he thought the proper way would be to allow the law to take its course, and Mr Kelly might then be present. WAIOTAHI HIGHWAY BOARD. Mr MacCormick made an application that the appeal in connection with this Board might be adjourned until Monday next, which was granted. The Court was then adjourned until that day.
