POLICE COURT.— Friday.

(Before J. O'Neill and G. B. Owen, Eeqs., Justices ) Drunkenness. —A. J Nicholls was fined 10s and costs, or to he imprisoned 48 hours, for a second offence. W. Oinnamond, for being drunk and disorderly, was fined 20s and costs, or to be imprisoned 48 hours with hard labor. Assault. —A charge of assault, brought by J. Uennessy against J. Russell, was dismissed, there being no appearance of either party. Embezzlement. —J. Hogarth was charged by J. Wnddcll, his employer, with having embezzled the sum of £6 14s 10_-d, the property of his employer. —J. Waddell deposed : I am a baker in Karangahape Rond. Prisoner lias been in my employment for fourteen months, and left on the Bth hiMant. He was employed to deliver bread and receive money for me, and to pay me it over every night on coming home. Ho was receiving from me 18s a wee°k. Mr. Hammond, on the Grafton Road, is my customer. He was in the habit, of paying me every month, through the prisoner. He paid me for tho month of September. I sent the bill through prisoner for October, November, and December. I did not receive payment of this account from prisoner or any one else. The receipts produced are in prisoner's handwriting. One bill lias been defaced and altered, as by an acid. On the 7th of the present month, in the evening, I asked him if he had received the amount of Mr. Hammond's account. This was the day on which the bill purports to have been received by the prisoner. —Mr. Alderson, of Remuera, is a customer of mine, and was supplied by prisoner. Last receipts for him was 28th September, This was for August. He was supplied during September and October. I furnished the bill through prisoner. The total amount for the two months was £1 13s lid. I had not received payment, for this. The bill produced is receipted in pencil by prisoner. Mrs. Wall, of Mount-street, is my customer, and was supplied during October by prisoner. This bill for eight shillings produced is receipted by prisoner. I have not had the money from him. I do not know why prisoner left me. He did not return to his duty. Ou the 9th I went round with the cart with another man, and ascertained that he had received bums not accounted for. On the 14th, after being arrested, prisoner spoke to me in the guardroom. He asked me not to prosecute him and I would be paid some of tho money now by his brother. The total amount embezzled is £15 6s Bid, so far as I at present know. - Susan Hammond deposed : I am the wife of Edward Hammond, interpreter, residing in Grafton Road. Witness c m-oborated previous evidence.—Agnes Mackie, servant to Mr. Stevenson, Remuera, deposed to having received bread from prisoner for Mr. Alderson, and to having received from Mr. Alderson the money in payment, which she handed .<• prisoner, and corroborated the eviden c of prssecutor. Mrs. Mary Hall, dressmaker, Mount-street, corroborated the statement of prosecutor. —Detective Ternahan deposed to his having arrested the prisoner on the 14th inst., at 11 at night. Prisoner asked Mr. Wacldell to not pi-ess the charge ngain9t him and his brother could pay him. lie said he had spent the money foolishly.—The prisoner was committed for trial.

Libel.—The Court (having adjourned till 2 o'clock) on resuming, the libel c se, Riehard.----y. Carter, wns called. —Mr. Wynn for the prosecution, Mr. MacCormick for the defence. — the charge was that, the defendant, who is inspector of the slaughl er- house at N ewmarkel, had written to the Superintendent diarizing the pro editor with perjury. His Honor tli^ Superintendent, on being called, entered the witness box, and, being sworn, declined te produce the letter "on grounds of public policy."—The case was accordingly dismissed.
