POLICE COURT.—Wednesday.
(Before J. M. Dargaville and G. P. Pierce; Esqrs, J.F.s) DRUNKENNESS. Cornelius Fagau and two natives, named, respectively John and James, were dealt with in the usual manner for this offence. VAGRANTS. James Herberto a-id Thomas Cain, each charged with having no lawful visible meanu of support. The prisoners pleaded not guilty. Detective Ternahan deposed that he arrested the prisoners in an empty ichare on tho Otahuhu Road, yesterday afternoon. They were lying down, with a house-breaking implement beside them known as a" J, mmy." The prisoners said they were looking for work. Inspector Broham said the prisoners had been several times convicted of this offence. The Bench considered tho ease proved, and sentenced each of tho prisoners to two months' hard labor. STOWAWAY. John Higgins was charged with being a stowaway on board tho Wonga Wonga, from Honolulu. The prisoner pleaded euilty. The Inspector of Police s.r.d the prisoner was known to be the greatest thief in New Zealand. Captain Stewart said that the prisoner had stowed away from this port on the last voyoge to Honolulu. The Bench fined the prisoner £5 ; or, in default of payment, to be imprisoned for three months. MUNICIPAL POLICE ACT. David Sheehan pleaded guilty to allowing one cow and three sheep to stray in Hobsonstreet, and was fined ss. and costs. William Jenuings, charged with a similar offence, pleaded not guilty, and was defended by Mr. Joy, LL.B. Constable Jeffrey that he saw three cows in Vincent-street, on Wednesday last. He wfcs told by a small boy that the cows belonged to a Mr. Tynesley. He has since been told that hey belonged to defendant. ■
SBy Mr. Joy: Cannot swear that all four belong to defendant. Can swear to one of them as the property of the defendant. Never looked for the brand. A boy named McEwe-', aged 12 years, was caUed, and being questioned as to the nature of an oath, corroborated tbe statement made by Constable Jeff, i y. A smaller boy was about to be put in the box, but Mr. Bro'.am objected, and said that he did not wish to pre.-s the case any further. The Rench, therefor», after a caution, dismissed the case. Thos. ."}> ankville, charged with driving a cart not bearing the name of the owner, pleaded guilty, aud was fined ss. and costs. nuisance. George Lendrum, livery-stable keeper, was charged by the Inspector of Nuisances with neglecting to keep his stable clean, as required. Mr. Wynn appeared for the complainant, and said that these offences were getting too frequent, and he (the learned counsel) submitted that the severest penalty should be inflicted. . The Inspector of Nuisances had a, very unpleasant duty to perform, aud should receive the support of the,- Bench and the Press. Mr. Young deposed to the facts of the case, and said that when he ordered the defendant to keep his stables cleaner, he (defendant) was very insolent. The Bench fined the defendant £5 and costs. BREACH OF THE LICENSING ACT. E. S. Williams was charged with a breach of the 38th clause of the Licensing Act, 1863. Air. H. H. Lusk appeared for the complainant ; Mr. Tyler for the defence. On the application of Air. Lusk, the case was withdrawn, the wrong party having been summoned. CAUTION TO RUTCHEES. R. S. Sandull, charged with killing one sheep on his premises, was fined £5 and costs, that being his second offence. The Court then rose. ]
