[Beforo Thomas Beckham, Esq., R.M.] Mr. Wtxn previous to the business of tho Court, drew his Worship's attention to the fact of having presented a memorial from the members of the legal profession. Ho now believed that an arrangement could bo made which, would be satisfactory to alt parties. He believed that the use of the Mechanics' Institute could be obtained if the Government would be in a position to hand over for the purpose of the Institute a building in Queen-street. He believed that .there was gome probability of an arrangement being carried into effect. The large room of the Mechanics' Institute was in every way suitable.

The plaintiff is a mail contractor, running coaches to the Waikato, and carrying the mails. The queßtion afc issue was, whether the plaintiff had a right to pass through the toll-bar without paying the toll. .:- •

Mr. Hesketh contended that the toll collectors have a right to demand the toll, and shut the gates if it was not paid, and that the burthen of proof was on the plaintiff to show that he carried the mails. :.;,;.■

Mr. MacOormick said that when passengers were carried it took awsiy the exemption. Q-eorgo Quick said, that he. had some coaches carrying the mails onlyV They left Auckland every morning 5 the coach to Ngaruawahia three times a week.; ■ The^ defendant collects the lolls at NewmarketJ Witness said he was obliged to run the coaches with the mails'. On the 4th July last the defendant rofused to let witness pass through the gate.
