(Before Thomas Beckham, Esq., District Judge.) Atf adjourned Bitting of the Court wp,s held yesterday, when tho following business ./was disposed of : —• STAITE V. BEES. Clniin, £99. Mr. Hesketh appeared for. the plaintiff. Mr. Wynn was counsel for the defendant. This was a claim 1 for salary. The praintiff was an articled clerk of Mr.' Rees, solicitor, while at Hokitika. Although the articles did not stipulate that any salary should be paid to the plaintiff, yet it appeared in evidence that ho had been allowed to draw for ~various periods of time, sums of £6, £5 and £4 a week as according to tho defendant," plaintiff had nothing to live upon. Tae defence was that the plaintiff had S drawn several sums, or rather credited himself ■with various amounts, which the plaintiff objected (■<">, aud which, he said, "he would never allow if he could help it." There were also sums which it was alleged the plaintiff had charged tho defendant with for expenses. The whole dispute was a matter of account extending over three years. The defendant pleaded a set off of £100 against the plaintiff's claim. It appeared that the defendant had paid a judgment and other debts on account of the plaintiff. His Honor Tva3 of opinion that the case whs one peculiarly fitting for arbitration. Mr. Wyhn said Mr. Rees had done all lie possibly could. His Honor thought the matter should be referred to some of the older members of the profession. j (Left Sitting.)
