DOG REGISTRATION ACT AMENDMENT ACT.

Sia, —I beg to draw your nt»ent : on to the fact (of which, it .eeins, the Akaroa R.M. i" not nwui'") of a claese intheabovunamed Act which provides that, if an owner legisler his dog before a summons for non-regisl ration is actually issued, he shall be exempt fiom the penalties prescribed by the Act as befoie. Now, as I was fined by tho Akaroa R.M. Court on the 12th May last (contrary to tbe Act) for an umegislered dog, the dog having been re&isiered on the 20_h April, and the summons issued on the 9th May, and believing the R.M. to be a just and hone* man, he will, I hope, when he finds error, remit tho fine. By inserting this your valuable paper you will oblige— Yours, etc., CH. MILLER. Le Bon's Bay. [We have ascertained that the police did not lay the information till May 9th, but as you appear never to have taken the trouble of communicating with the Court, how was the Magistrate to know whether the dog was registered even on the 9th of May ? Why did you not show your receipt to the police when you received the summons? We see by reference that you were present in the Court, and pleaded guilty. No doubt, if as you say you registered on the 26th April, you were exempt by clause 3 of the Dog Act Amendment Act, which for general information we quote as follows: —" Where any person, without having been summoned to enforce such payment, shall have paid the registration fee for any dog after ihe expiration of the time limited ior such regLlration. he shall he exempted from the pet ahy imposed by the said Act for not . (Fc ting such registration within the nroper tini", and shall not be liable to be summoifd for the payment of such penalty." We are afraid that as you did not make the plea nt the proper time that th" M igistrate (who was doubtless nwafe of the clause) ban no power whatever to remit the line, however much he may Mail.] '
