Mr Pitcaithly appeared to ask leave to appeal in the case t Lay v. Pitcaithly, and on being asked his ground.-* presented the following document to the Hunch :— '■ In the Resident Magistrate';* Court, Aknroa district. Pitcaithly v. Hay. " Tako notice that I intend to apply to the llc.sident Magistrate of the Akaroa district, at the next sitting of tho Court after the service of this notice, for a ro-

hearing of this case on the following grounds :—lst That the defendant's witnesses committed gross perjury ; 2nd That (he plnintiir lias additional evidence to substantiate his claim ; 3rd Thnt the verdict was entirely against the evidence." James Pitcaitiily. Plaintiff. November 14, 1881." The Magistrate asked what additional evidence Mr Pitcaitiily proposed to bring for .vanl. Mr Pitcaitiily s.iid that it was evidence he was ready to produce at the last hearing of the case, which the Magistrate had refused to listen to. The Bench said they had not refused" to listen to any evidence produced at the hearing of the case. Mr Holmes, plaintiff's solicitor, had closed his case, thereby showing he had no more evidence to bring forward that he thought pertinent to the case ; such being the case he must refuse to grant a rehearing. Rehearing refused accordingly. The Court then adjourned.

Wednesday, Nov. 16. Before J. D. Garwood, Esq., J. P. BR BACH OV REGISTRATION ACT. Andrew Seaton was charged with neglecting to register the birth of his child within six months of its birth. The accused, who showed that the neglect of registration was only the result of forgetful ness, was fined ss, and costs 7s. The Court then adjourned.
