It was shown in defence that the goods were not placed on the pavement, but suspended from a verandah. The police authorities urged this practice tended to increase petty larcenies. The Bench decided that such exposure was an offence under the Police Ordinance, but treating this as a test case, inflicted a nominal fine, stating that future offences of the kind would be severely dealt with.
