AKAROA RESIDENT MAGISTRATE'S COURT.

«. Tuesday. May 10, 1881. Before Justin Aylmer, Esq., R.M. civil cases. Brocher v. D. Libeau.—Claim £9 4s 6d. In this case the evidence was conflicting, and it was adjourned for the production of a witness till Friday, May 20. Same v. Lemmonier.—Claim £1 15s. Judgment by default for amount claimed and costs. tW. H. Wood v. G. R. Joblin.—Mr Henning appeared foi the plaintiff. This was a claim for £7, damages for non-delivery of grass seed puichased by plaintiff. The case for the plaintiff was that a day or two before April 7 Mr Wood made an agreement to buy defendant's seed at 4s & bushel, if not sold by that date. On April 7 defendant told Mr Johnson, who is in plaintiff's employ, that plaintiff could have the seed at the price named. Subsequently plaintiff sent over a stamped agreement, which Johnson requested defendant to sign. Defendant refused to sign the agreement, but said plaintiff could have the seed on payment of the price agreed on. On or about April 23d plaintiff received a letter from defendant, stating that he had sold the seed in Christchurch. Defendant did not deny making the bargain at the price named, but contended that plaintiff had unreasonably delayed the completion cf his bargain. He elicited from Johnson that at the time of the agreement to sell he (defendant) had stated that he wanted the money. When the stamped agreement was tendered to him there had been plenty of time for the seed to have been delivered and paid for, and it was therefore quite unnecessary. In despair of getting a settlement with Mr Wood, he had gone to town on tho 22nd and sold tbe seed. His Worship reserved his decision till Friday, the 13th inst. The Court then adjourned.
