AKAROA RESIDENT MAGISTRATE'S COURT.
Tuesday, September 21, 1880. ,(Befor'e Justin,Aylmer, Esq., RM., and ' H. H. Fenton, Esq, J.P.) CIVIL CASES. Jonathan Roberts v. Herbert Hewer. Claim 2s, damages for illegally pounding a horse. Mr Nalder appeared for the plaintiff. In this case it appeared that the defendant, acting in his capacity a,* ranger for- the Akaroa Board, hadompounded plaintiff's horse, which he had found'grazing on tho plot of land between i the Town Hall and Mr Meech's property; lls had been charged for driving fee, and Is for impounding. Several'witnesses wero called, who gave evidence to the fact of defendant having driven tho horse off the sections in question (private ones), and impounded it. Defendant stated bo; had done so acting in his capacity as ranger, but he believed any one might impound cattle or horses found wandering at large. Tho Bench said that might bo the case, but driving fees .could not be charged. They thought Plaintiff should not allow his horse to wander at large, but still according to the Borough bye-laws it was the duty of tho officers appointed by, or belonging to, the Corporation to see to t|ie : of such animals.
